| Ryanair flouted EU rules by refusing compensation to a passenger who was stranded by the volcanic ash cloud in 2010, the European Union's court of justice has ruled.
The case relates to Denise McDonagh from Ireland whose flight from Faro to Dublin, scheduled for 17 April 2010, was cancelled because of the eruption of the Eyjafjallajökull volcano in Iceland. As a result of the ensuing ash cloud, airspace over a number of EU countries – including Ireland – was closed between 15 and 22 April 2010, because of the risks to aircraft.

| Well it's of no surprise that Ryanair tried to get out of paying anything, although in this case I have a certain amount of sympathy for them, as it wasn't like they could control the air authorities decision to close airspace. The real culprits are the insurance companies who refused claims as it was an act of god. Whats the point of insurance if it's not to cover something that's unexpected? |

| yes that what I said to Mrs Db when she read it out from the paper, volcano a bit unfair and should be insurance. However, this new ruling will only increase fares as the airlines will build in the costs |

Well funny enough, this flight delay compensation was introduced in 2006, but the cases in the English Courts were stayed until last October whilst the airlines appealed up to the ECJ. The airlines lost, and compensation for a 3 hour delay is now a mandate, unless the airline can prove extraordinary circumstances. EC's can include weather related issues such as runways shut cos of snow. But Ryanair have been charging a €3 pp EU261 (compo ruling reg number) Levy for several years! Never one to miss a trick Mr O'Leary |

| Nothing surprises me about Ryanair any more. But like Mark says, it was more to do with the Insurance Companies TBF. _________________ Mick
